Terms of service

These Terms of Service govern your use of the eteaket website and purchases made through our online retail store. The website and store are operated by eteaket Limited, company number 05815249.

By using our website or placing an order, you agree to these Terms. Nothing in these Terms affects rights you have as a consumer which cannot lawfully be excluded.

Products

We take reasonable care to describe and photograph our products accurately. Natural products such as tea may vary slightly in appearance, colour, leaf size or other characteristics, and the appearance of products on your screen may vary according to your device.

Product ranges, ingredients, packaging, availability and prices may change from time to time. You should always check the product packaging and information supplied with a product where you have allergies or specific dietary requirements.

Orders

When you place an order you are making an offer to buy the products in your basket. An automated order acknowledgement confirms that we have received your order but does not necessarily mean that we have accepted it.

We may decline or cancel an order where, for example, a product is unavailable, payment cannot be authorised, there is an obvious pricing or product error, we cannot deliver to the address supplied or we reasonably suspect fraud or misuse.

If we cancel an order after you have paid, we will refund the amount due.

Prices and payment

Prices displayed to UK consumers include VAT where applicable unless clearly stated otherwise. Delivery charges are shown separately before you complete checkout.

Payment must be made using one of the payment methods offered at checkout.

We may correct obvious pricing mistakes. If an error affects an order you have already placed, we will contact you and give you the choice of continuing at the correct price or cancelling the affected product.

Delivery

Delivery is governed by our Shipping Policy. Delivery dates are estimates unless expressly stated otherwise.

You are responsible for supplying a complete and accurate delivery address. If an order cannot be delivered because incorrect or incomplete information was provided, additional delivery charges may apply where we have to resend it.

International orders

We sell internationally. Orders delivered outside the UK may be subject to import VAT, customs duties, tariffs, brokerage fees or other local charges.

Unless expressly stated otherwise at checkout, these charges are not collected or paid by eteaket and are the responsibility of the recipient. Customs procedures may also delay delivery.

You are responsible for ensuring that products ordered may lawfully be imported into the destination country.

Returns and consumer rights

Our Refund Policy explains your cancellation and return rights.

Nothing in these Terms limits your statutory rights in relation to goods which are faulty, damaged, not as described or otherwise fail to conform to the contract.

Subscriptions

Where you purchase a Subscribe & Save product, you are agreeing to recurring orders and payments at the frequency shown when you subscribe.

Current eligible Subscribe & Save products receive a 10% discount, subject to the terms shown at purchase. There is no minimum term or minimum number of deliveries.

You may pause, skip, amend or cancel a subscription at any time before the next recurring charge is processed. Further details are set out in our Purchase Options Cancellation Policy.

Tea Tokens and promotions

Tea Tokens and other loyalty benefits, promotions, discount codes and offers may be subject to separate rules shown when you join or participate.

Unless otherwise stated, promotional offers cannot be exchanged for cash and may not be used in combination with another promotion.

We may amend or withdraw loyalty schemes and promotions on reasonable notice, subject to any rights already accrued by customers.

Gift cards and vouchers

Gift cards and vouchers are subject to any validity period and conditions stated when purchased or issued. They cannot normally be exchanged for cash except where required by law.

Accounts

If you create an account, you are responsible for keeping your login information secure and for activity carried out through your account.

Please contact us promptly if you believe your account has been used without permission.

Reviews and content submitted by customers

If you submit a review, photograph, comment or other content to us, you confirm that you have the right to provide it and that it is not unlawful, misleading, defamatory or infringing.

Where you submit content for publication, you grant us a non-exclusive, royalty-free licence to display and use that content in connection with eteaket's website, products and marketing, subject to applicable law.

Intellectual property

The eteaket name, branding, website content, photographs, graphics, product copy and other materials belong to eteaket or our licensors.

You may not reproduce, modify, distribute or commercially exploit them without permission, except as permitted by law.

Website availability and third-party services

We do not guarantee that the website will always be available or free from technical errors.

Our website uses services provided by Shopify and other third parties. Third-party websites and services are subject to their own terms and privacy practices.

Liability

We do not exclude or restrict liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

We are responsible for losses which are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable when the contract was formed.

Where you purchase as a consumer, we supply products for private and domestic use. We are not responsible for business losses arising from consumer purchases.

Events outside our control

We are not responsible for delays or failures caused by circumstances outside our reasonable control, such as severe weather, postal or courier disruption, industrial action, customs delays or major supply-chain disruption. This does not affect rights you may have under consumer law.

Governing law

These Terms are governed by the laws of Scotland.

If you are a consumer living elsewhere, you retain any mandatory consumer protections available to you under the law of your country or part of the UK. Nothing in these Terms prevents you bringing proceedings in a court where consumer law gives you the right to do so.
